Terms of Service

To use our terms of service and access Owntake:

• You must be at least 18 years of age or the age of majority in your jurisdiction.

• You must possess the legal authority to enter into these terms of service.

• If you upload photos, videos, or audio featuring real individuals, you represent and warrant that every depicted person is an adult (at least 18 years old) and has granted you express, informed consent for this processing.

You may access Owntake either by registering an account via email or Google sign-in, or through one-time guest access:

• Account Responsibilities: You are responsible for safeguarding your login credentials and for all generation tasks initiated under your account.

• Guest Access: Guest transactions store a randomized session identifier in your browser's local storage to associate purchased credits and videos. You may merge a guest session into a permanent account upon sign-in.

Video generation on Owntake operates on a transparent credit system:

• Credit Packs: Credit packs are one-time purchases. Pack credits never expire and remain available as long as your account remains open.

• Monthly Subscription Plans: Monthly subscriptions automatically replenish a set quota of credits every 30 days. Monthly subscription credits reset at each billing cycle and do not roll over.

• Deduction Order: When generating, the system consumes expiring monthly subscription credits first, followed by permanent credit pack balances.

• Payment Processing: Payments are securely processed through Stripe. We do not store your full payment card details on our servers.

• Automatic Refund on Failure: If a generation job fails due to a model error, system timeout, or internal fault, the reserved credits are returned automatically to your balance.

• Ownership of Uploaded Content: You retain all intellectual property rights in the text prompts, photographs, and media you upload to Owntake. You grant us a strictly limited, non-exclusive license to process your assets solely to generate your requested video.

• Ownership of Generated Output: Subject to your compliance with these terms of service and applicable law, you own the video files generated through your account and may use them for commercial or personal purposes.

• Data Retention: Under our automated data management schedule, uploaded source images are deleted as soon as generation completes, and in all cases within 24 hours. Completed video files are stored in your library for 30 days, after which they are deleted automatically. You may manually delete any video from your library at any time.

Outputs are generated by probabilistic machine learning models. You acknowledge that:

• AI video models may produce unexpected visual artifacts, physical distortions, or variations across runs.

• Owntake does not warrant that generated videos will meet specific artistic expectations or remain identical across iterations.

• If you are unsatisfied with your initial purchase, you may request a refund under our refund policy.

You agree to comply with our acceptable use policy. You may not generate or attempt to generate content that involves:

• Minors or individuals who look under 18 years of age.

• Non-consensual imagery, harassment, defamation, or stalking.

• Celebrities or public figures without explicit commercial authorization.

• Sexually explicit, violent, or unlawful depictions.

• Fraudulent impersonation or deceptive synthetic media.

Violation of these standards may result in immediate task cancellation, forfeiture of remaining credits, and account termination without refund.

To the maximum extent permitted by applicable law, Owntake and its operators shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total aggregate liability under these terms of service shall not exceed the amount actually paid by you to Owntake in the 12 months preceding the claim.

We may update these terms of service periodically to reflect technical enhancements, model updates, or legal compliance changes. Significant updates will be noted by revising the "Last updated" date at the top of this document. Continued use of the platform after updates signifies your agreement to the modified terms of service.
